Term of Use
Welcome to the KnockKnock Community Mobile Application (the "App"). By using the App, you agree to be bound by these Terms of Use.
1. Term of Use
These Terms of Use apply to your use of the App, including but not limited to:
Purchasing points from the App;
Purchasing products or services from merchants on the App;
Posting requests or accepting requests in the community group channel;
Using any other features or functionality of the App.
2. Purchase of Points
You may purchase points from the App. Points are a virtual currency that can be used to purchase products or services from merchants on the App.
3. Merchants
Merchants may sell their products or services on the App. When you purchase a product or service from a merchant, you are entering into a contract with the merchant, not with KnockKnock.
4. User Requests
You may post requests in the community group channel. When you post a request, you are making a public offer to anyone who sees the request.
5. User Acceptance
You may accept requests that are posted in the community group channel. When you accept a request, you are entering into a contract with the person who posted the request.
6. Removal of Content
The owner of the App has the right to remove any content from the App, including but not limited to user requests, merchant postings, and user accounts.
7. Refund Policy
You may be entitled to a refund for a product or service that you purchased from a merchant on the App. The refund policy will be determined by the merchant.
8. Service Charge
There is a service charge for every transaction that is made on the App. The service charge will be determined by KnockKnock.
9. Compliance with PDPA
KnockKnock complies with the Personal Data Protection Act 2010 (PDPA) of Malaysia. When you use the App, you agree that KnockKnock may collect, use, and disclose your personal data in accordance with the PDPA.
10. Indemnification
You agree to indemnify and hold harmless KnockKnock and its affiliates, officers, directors, employees, agents, and representatives from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App.
11. Disclaimers; Limitation of Liability
THE APP IS PROVIDED "AS IS" AND KnockKnock MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. KnockKnock DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER MALICIOUS SOFTWARE.
IN NO EVENT SHALL KnockKnock BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, INCOME, OR PROFITS), WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH THE APP, EVEN IF KnockKnock HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Dispute Resolution
Any disputes arising out of or in connection with these Terms of Use will be resolved by binding arbitration in accordance with the rules of the International Chamber of Commerce. The arbitration will be conducted in English and the arbitral award will be final and binding.
13. Third-Party Sites and Services
The App may contain links to third-party websites and services. These links are provided for your convenience only and do not imply any endorsement by KnockKnock of the third-party website or service. KnockKnock is not responsible for the content or privacy practices of any third-party website or service.
14. General Terms and Condition
These Terms of Use may be amended from time to time by KnockKnock. The most current version of the Terms of Use will be posted on the App. You are responsible for reviewing the Terms of Use periodically to stay informed of any changes. Your continued use of the App after any changes to the Terms of Use will constitute your acceptance of those changes.
15. Governing Law
These Terms of Use will be governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms of Use will be subject to the exclusive jurisdiction of the courts of Malaysia.
